This is a legal agreement between You, a user of Sumdog (referred to as "You" or "Your" throughout the Agreement) and Crocodile Clips Ltd, a company registered in Scotland ("We", "Us" or "Crocodile Clips"). It describes the terms on which you may use the Sumdog website ("Sumdog").
Before you use Sumdog, you should make sure that you understand and accept these terms. Whenever you use Sumdog, you accept that you're entering into an agreement with Crocodile Clips on these terms.
If you are under 13 years old, you need permission from a parent, a guardian or (when at school) a teacher before you use Sumdog. Also, your parent, guardian or teacher will need to register on your behalf. There may be additional restrictions, which vary from country to country, below certain age limits.
Using Sumdog
When using Sumdog, you agree that you will:
- make sure that information you give us about yourself is true and complete;
- tell us immediately if any of this information changes;
- be responsible for keeping Your login details private;
- tell us straight away if you believe that someone else knows your login details, or if there has been any unauthorised use of them.
- be responsible for any actions which take place under Your login;
- only use Sumdog in a manner that is consistent with these Terms and Conditions;
- show respect and consideration to other users.
And you accept that...
- If you wish to make any claim against another user arising from their use of Sumdog, you will pursue it only against them, independently of Crocodile Clips.
And you agree that you will not:
- use Sumdog in a way that breaks any laws or regulations, or for any illegal purpose;
- try to use parts of Sumdog that you're not authorised to use;
- impersonate another person, or pretend that you own any material;
- collect or store personal data, except where we permit it;
- alter Sumdog or its infrastructure, or disrupt it
- transmit onto or through Sumdog...
- bulk messages, or unsolicited commercial messages, chain letters or anything similar;
- anything which may be harmful to software, hardware or communications equipment;
- anything which may be offensive or damaging to others;
- anything which infringes someone else's rights;
... or help anyone else to do any of these things.
If you use Sumdog in any way that doesn't fit with our Terms and Conditions, we may choose to immediately terminate your use of Sumdog.
Personal data and privacy policy
We are committed to protecting your personal information. This section covers our use of any personal information we obtain from you when you use Sumdog.
Our online payment systems are provided by Google Checkout. Google's privacy policy covers the data collected during the payment process.
What information do we collect?
When you sign up for one of our services we may ask for personal information about you, such as your name, date of birth, your job and email address. By entering these details accurately it enables us to provide the best possible service.
Most of your information is stored on our servers. However we also use small files (such as cookies and licence files) to store some information on your computer. This reduces the amount of form filling required each time you use our websites or software.
With certain services we also look at your IP address and other data that identifies your computer and country. We use this to personalise your user experience for a particular country and to detect illegal use of our software. This information is not used to develop a personal profile of you.
We keep the emails you send to us about queries you may have. We do this so we can track the quality of our service.
How will we use the information we collect about you?
We will use your personal information as follows:
- to provide you with information in order to help you use one of our services, such as sending you an email notifying you of the end of a service trial period;
- to personalise our services for you
- to provide you with your licensing or login information.
- to identify breaches of our licensing terms, so in the worst cases of abuse we may take action against illegal use. This helps maintain free services and lower prices for our law-abiding customers;
- to request feedback from you about our services so that we may improve the service; and
- to inform you of other & upgraded services that may be of use to you. If you do not wish to receive this information you may opt out.
Where Crocodile Clips uses your personal information for any other uses we will seek your permission prior to doing so.
What if you are aged under 18?
If you are aged under 18, please get your parent or guardian's permission before providing us with personal information. Users without this consent are not allowed to provide us with personal information.
Parents can write to us using the address below to find out what information we hold on their children, or to request that we delete it.
Will we share your personal information with anyone else?
Generally, we will keep your information confidential except:
- where disclosure is required by law;
- there has been a clear breach of our licensing terms. In this case we may share information with our partners, lawyers and/or law enforcement agencies in the relevant country;
- when you have made a sales enquiry or joined the Leader in Technology initiative from a country where we have a partner. In this case we may forward your enquiry; or
- when you have provided explicit permission to pass your information to a third party.
Except as described here, or where authorised by you in writing, we will not pass on your Personal Data to any other party.
In addition, we share statistics derived from collected information with our partners worldwide. The statistics do not enable our partners to identify you.
Content you post on our website
If you post offensive, inappropriate or objectionable content on our websites, we may use your personal information to stop such behaviour.
Where we believe that you are or may be in breach of any law, we may use your personal information to inform relevant third parties such as your employer, school, e-mail/internet provider or law enforcement agencies.
Can you access and update your personal information?
Under the Data Protection Act in the UK you have the right to request a copy of the personal information we hold about you and to have any inaccuracies corrected. (We charge £10 for information requests and will require you to prove your identity with 2 pieces of approved photographic identification). We will use reasonable efforts to supply, correct or delete personal information about you on our files.

Copyright and copying
Unless otherwise stated, the copyright, trademarks and all other intellectual property rights in any material on Sumdog shall remain at all times vested in Crocodile Clips or its licensors.
You may...
- use Sumdog for your own personal education and entertainment;
- download, store or print the progress reports provided on Sumdog, for your own personal use, or for use at Your Institution.
You may not...
- use Sumdog or its content in any other way - in particular, but not limited to, any commercial or public use;
- reproduce, or make available to others, Sumdog's content;
- modify or create derivative works from Sumdog's content.
... or help anyone else to do any of these things, unless you already have written permission from Crocodile Clips.
You agree that...
- you are responsible for content you submit to Sumdog;
- you grant us an unrestricted, royalty-free, perpetual, worldwide license to use, reproduce, modify, publish, translate, distribute or create derivative works from any content you submit to Sumdog;
- you irrevocably and unconditionally waive the benefit of any provision of law known as moral rights of authors, or any similar law in any country, for ever, in respect of any content you submit to Sumdog;
- you may not submit anything that is owned by someone else to us unless you have obtained permission from its owner first.
Changes to these Terms and Conditions
We may modify these Terms and Conditions from time to time, in which case we will notify you by posting the new version on the Sumdog Terms and Conditions webpage.
It's your responsibility to be aware of the current Terms and Conditions. Any modifications or additions will come into effect as soon as they are posted, and if by using Sumdog after that time, you show that you agree to the modifications.
Limitation of liability and indemnity
Unless otherwise agreed, we make no warranties of any kind, either express or implied, in relation to Sumdog.
We will not be liable for any loss occurring as a result of using Sumdog.
Nothing in these Terms and Conditions limits your rights as a consumer under Scots law, or limits our liability for death or personal injury resulting from our negligence or that of our employees or agents.
You agree that you fully indemnify us against all claims, liability, losses, costs and expenses - including legal fees - suffered by us which arise from a breach of this Service Agreement by you, or from your use of Sumdog, or from use of Sumdog by any other person who accesses Sumdog using your Login Details, computer or internet account. Furthermore, you agree that you are fully responsible for such claims, losses, costs and expenses or liabilities.
Third Parties and External Links
Sumdog may carry advertising for other Crocodile Clips products or services.
It may also carry links to third party websites, who may offer you goods or services or the opportunity to take part in promotions.
We are not responsible for third party websites, or their content. Any dealings you have with them are between you and the third party, and completely independent of Crocodile Clips, and We cannot be held responsible if you should suffer damage or loss when dealing with them.
